Welcome to DAM Creative. These Terms of Service explain how we work, what you can expect from us, and what we expect from you when using our services. By contacting us, commissioning work, or using our website, you agree to these terms.

1. About Our Services

DAM Creative provides creative services including branding, graphic design, web design and development, social content, video editing, motion design, e-commerce websites, vehicle graphics, and white-labelled creative support.

Every project is unique. The details, scope of work, timelines, pricing, and deliverables for each project will always be outlined clearly in a separate proposal or contract before any work begins. That individual contract will take priority over the general terms listed on this page.

2. Project Agreements

Before starting any project, we provide a written agreement or proposal that sets out:

  • The scope of work

  • The timeline and deliverables

  • The cost and payment terms

  • Revision allowances

  • Responsibilities on both sides

By approving a proposal, paying a deposit, or allowing work to begin, you are agreeing to the terms set out in that specific project agreement.

​

No work will begin until the deposit or initial payment (if required) has been received.

​

3. Payments

Payment terms differ depending on the project. They will always be outlined in your individual agreement.
In general:

  • Deposits are non-refundable unless otherwise stated

  • Work will not continue if payment terms are not met

  • Final files will only be released once full payment has been received

Late payments may delay project timelines.

​

4. Revisions

Each project includes a set number of revisions, which will be clearly stated in your proposal or contract.


Additional revisions outside of the agreed number may be charged at an hourly or fixed rate.

Keeping feedback clear, timely, and organised helps us maintain your timeline.

​

5. Timelines

Project timelines vary depending on the complexity and scope of work. Timelines will always be outlined in your project agreement.

Delays may occur if:

  • Content, materials, or information from the client are late

  • Payments are not made on time

  • Feedback is delayed

​

We will always communicate clearly if anything affects the agreed schedule.

​

6. Client Responsibilities

To complete your project smoothly, we may require information, content, feedback, or approvals from you.


You agree to:

  • Provide timely and accurate information

  • Respond to communication within reasonable timeframes

  • Supply any required assets (logos, text, images etc.)

We are not responsible for delays caused by missing information or late responses.

​

7. Ownership and Usage Rights

Ownership of final files and usage rights will be clearly explained in your project agreement.


Unless otherwise agreed:

  • DAM Creative retains ownership of working files (e.g., PSD, AI, AE project files)

  • Clients receive rights to the final exported deliverables

  • Unused design concepts remain the property of DAM Creative

If you need full ownership or source files, this must be agreed upon prior to starting the project and may involve an additional fee.

​

8. Cancellations and Refunds

If you wish to cancel a project:

  • Deposits are non-refundable

  • Work completed up to the cancellation date must be paid for

  • Any remaining work in the contract will not be carried out

​

If DAM Creative needs to cancel for any reason, you will be refunded for any work not yet delivered.

​

9. Website & Technical Services

For web projects, we are not responsible for:

  • Hosting issues

  • Third-party platform outages

  • Security breaches on external systems

  • Changes made by the client or third parties after handover

​

We offer optional ongoing support or maintenance if required.

​

10. White Label Work

If we work under your business name, you agree to represent our work accurately and ethically.
We will not contact your clients directly unless you ask us to.

​

11. Liability

DAM Creative is not liable for:

  • Loss of income

  • Loss of business

  • Loss of data

  • Delays caused by third parties or client actions

  • Issues arising from content provided by the client

​

Our responsibility is limited to the value of the project agreement.

​

12. Changes to Terms

We may update these Terms of Service occasionally. The latest version will always be available on our website.
